Having practiced together since 1988, Frank Luccia and Mary Kathleen Evans created
Luccia & Evans, L.L.P. in April, 2003.  While the attorneys in the firm have diverse
backgrounds, they share a commitment to provide clients with high quality legal services in
response to individual needs.  The firm limits its practice to civil law.  

The following paragraphs briefly describe each attorney's background and  areas of
expertise.

FRANK N. LUCCIA

Frank N. Luccia was admitted to the Texas Bar in 1986.  Born in Cherry Hill, New Jersey on
May 10, 1961, Mr. Luccia received his B.S. in Finance, magna cum laude, from St. Louis
University in 1983 and his J.D. from the University of Houston Law Center in 1986.  In
addition to his admission to practice in state court, Mr. Luccia is also admitted to practice
before the United States District Court for the Southern District of Texas.

Mr. Luccia developed the firm’s Continuing Quality Assurance Plan which helps the firm
members provide the highest quality legal product, service and reports.  Mr. Luccia
remains responsible for its administration.  He is also the firm’s managing partner.  Mr.
Luccia is a member of the Houston Bar Association, Greater Houston Society for Health
Care Risk Management, State Bar of Texas, American Bar Association, and Defense
Research Institute.

In 1999, Mr. Luccia became an adjunct professor of  law at the University of Houston Law
Center in the health law section.  He speaks frequently at hospital in-service programs and
continuing legal education seminars.  He has contributed to several risk management
news letters and other health care related journals.  A certified mediator since 1999, Mr.
Luccia has experience in mediation of personal injury, wrongful death and healthcare
liability disputes.  

MARY KATHLEEN EVANS

Mary Kathleen Evans was born in Detroit, Michigan on January 24, 1963.  Admitted to the
Texas Bar in 1988, Ms. Evans is also admitted to practice before the United States District
Courts for the Southern, Eastern and Western Districts of Texas.  Ms. Evans was
graduated from The University of Texas in 1985, cum laude with special honors in
government, and was in the Golden Key International Honor Society.  She earned her J.D.
from The University of Houston Law Center in 1988.  

Ms. Evans worked as a law clerk for Kruse & Associates while in law school.  Upon
graduation, she joined the firm as an associate and became a partner at Kruse & Luccia, L.
L.P. in 1996.  Ms. Evans' practice includes professional liability, products liability, nursing
home liability, general liability, toxic tort, employment law , business law and general civil
litigation.  She represents health care professionals in peer review actions.  She has
lectured on the subjects of Psychiatry & the Law, Good Samaritan laws, Deceptive Trade
Practices, sovereign and official immunity and the Nurse Practice Act, as well as  various
subjects in continuing medical education and continuing nursing education seminars.

Ms. Evans is a member of the State Bar of Texas; College of the State Bar of Texas;
American Bar Association; Houston Bar Association, serving on the HIV-AIDS Outreach
and Interprofessional Drug Education Alliance (IDEA) and Professionalism committees;  
Defense Research Institute; and Greater Houston Society for Healthcare Risk
Management; (Past) Ethics Committee Chair of Plaza Specialty Hospital and (past)
President of Entrepreneurial Women Presidents.




Mary M. Wagner

Mary M. Wagner was admitted to the Texas Bar in 1992. Born in Fort Dodge, Iowa on March
9, 1960, Ms. Wagner received her A.A. in Photography from Hawkeye Institute of
Technology, her B.B.A. in Finance from The University of Texas, and her M.B.A. and J.D.
from the University of Houston. In addition to her admission to practice in Texas state
courts, Ms. Wagner is also admitted to practice before the United States District Court for
the Southern District of Texas.

Ms. Wagner has worked in the areas of professional liability, products liability, nursing
home liability, general civil litigation and family law litigation. In 2007 Ms. Wagner became
a Certified Identity Theft Risk Management Specialist (CITRMS), and consults extensively
with small businesses regarding compliance with the federal and state identity theft and
privacy laws, writing employment policy required under the identity theft laws, and providing
training for employees in the workplace.  

Ms. Wagner is a member of the State Bar of Texas, the Houston Bar Association and the
Greater Houston Society for Healthcare Risk Management.





Joseph I. Balat

Joseph I. Balat was born November 3rd, 1978 in Houston, Texas. He graduated from
Trinity University in 2000 with a B.A. in History and was a member of Phi Alpha Theta. He
received his J.D. in 2003 from St. Mary's University School of Law. While in law school, Mr.
Balat was a co-founder and first president of the Alternative Dispute Resolution
Association, as well as a two time recipient of the Dean's Leadership Award.

Mr. Balat's practice involves defense of alleged physician malpractice, hospital negligence,
products liability, and premises liability claims.  He also assists physicians with Texas
Medical Board actions.  Mr. Balat has represented clients as both plaintiffs and defendants
in other areas of litigation, including personal injury, deceptive trade practices, breach of
fiduciary duty, breach of contract, and fraud. Mr. Balat has represented clients on both
sides of the bar in several federal court cases as well, including ADA compliance cases
and mass tort litigation.  Mr. Balat is also a qualified mediator.  Mr. Balat is licensed to
practice in Texas state and federal courts.

Mr. Balat is a member of the State Bar of Texas and the Greater Houston Society for
Healthcare Risk Management.







Jonathan M. Jabcuga

Johnathan M. Jabcuga was born in Houston, Texas and was graduated from The
University of Texas with a BA in History in 2005.  Mr. Jabcuga received his JD from
Washington School of Law in St. Louis, MIssouri in 2010.  He is licensed to practice in the
states of Texas and Missouri.

Mr. Jabcuga focuses his practice in the defense of healthcare liability claims and non-
subscriber workers compensation.  He is a member of the State Bar of Texas and the
Greater Houston Society for Healthcare Risk Management












NURSE PARALEGALS

Charlotte Warmington, R.N., B.S.N., L.N.C.C., C.L.C.P.

Charlotte Warmington was born in Houston, Texas on January 31, 1958.  In 1982, Ms.
Warmington received her B.S.N. in Nursing from The University of Texas, Health Science
Center.  Upon graduation, she joined the full-time staff at Texas Children's Hospital in
Houston Texas until 1992, when she entered the legal field as a legal nurse consultant.  
Ms. Warmington has been a certified Legal Nurse Consultant for over ten years and in
2004 became a Certified Life Care Planner.  

Ms. Warmington has an extensive background in nursing, serving in clinical, management
and educational roles.  She has over thirteen years of experience in the areas of Neonatal
Intensive Care & Surgery, Pediatric Intensive Care, Newborn Nursery, and Progressive
Care caring for children with respiratory, neurological, as well as medical-surgical
disorders.  

Ms. Warmington has worked as a nurse reviewer and consultant in medical malpractice,
personal injury and products liability cases for over fifteen years.  She has  provided
support in managing several mass tort cases involving catastrophic events,
pharmaceutical products, medical devices and toxic exposures  for over fifteen years.  Ms.
Warmington has extensive experience in deposition, mediation and trial preparation.
